The Gill Tract Community Farm, a joint venture between the University of California - Berkeley and the local community, is facing allegations of racial discrimination.

The farm, which is dedicated to urban farming and food justice, is accused of banning White individuals from its premises on Saturdays, reserving the day solely for 'Black, Indigenous, and People of Color' (BIPOC).

The Mountain States Legal Foundation (MSLF) has lodged a complaint with the US Department of Education, contending that the farm's policy is a manifestation of 'systemic racism.' The MSLF's complaint includes an email from a farm program manager stating, "Saturdays are exclusively BIPOC. Exceptions have only been made for events that are BIPOC-centered and with plenty of advance notice and planning."

The UC Gill Tract Community Farm, as described on its website, is a collaborative project focused on food justice and urban farming. The farm, located at the intersection of San Pablo Ave and Marin Ave in Albany, CA, allows individuals to harvest food in exchange for assistance with weeding, planting, and watering. The farm also operates a sliding-scale farmstand and collaborates with several East Bay community organizations and food pantries to distribute fresh organic produce to those who lack access to it.

William Trachman, general counsel for MSLF, expressed his concerns to The New York Post, stating, "UC-Berkeley thinks that racial segregation is progressive now, but it's no different than segregation of the past." Trachman, a UC-Berkeley alumnus himself, further argued that the alleged policy of barring Caucasians from the farm on Saturdays is a clear violation of Title VI, which prohibits educational institutions from engaging in or allowing race discrimination. He urged the federal authorities to conduct a comprehensive audit of every UC-Berkeley program to uncover what he alleges is "systemic racism."

The complaint also includes an email from a farm program manager, who wrote, “I trust you stand in solidarity with upholding boundaries around that safe and sacred space.”

Upon being contacted by The New York Post, a UC-Berkeley representative stated that they were not previously aware of the discrimination complaint. UC-Berkeley spokesman Dan Mogulof responded to the allegations, stating, “The anonymous texts attached to the complaint have no specific information about time or place. And, as you can see, the Gill Tract’s website and calendar make no mention whatsoever of any program or activity of the sort described in the complaint.”
